Under Art. 33 DSGVO a controller must notify the competent supervisory authority of a personal-data breach "ohne unangemessene Verzögerung und möglichst binnen 72 Stunden" after becoming aware of it. Where the breach is likely to result in a high risk to the rights and freedoms of natural persons, Art. 34 DSGVO requires that the affected data subjects be informed as well. Breaches that are *unlikely* to result in a risk need not be reported, but the reasoning must still be documented (Art. 33 Abs. 5 — Dokumentationspflicht).
